General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Rüya Moda, owner Vildan Özsayan, Landstraße 69, 45968 Gladbeck (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller via his online shop.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
1.4 Deviating terms and conditions of the customer will not be accepted unless the seller expressly agrees to their validity in writing.

3. Conclusion of contract
3.1 The product presentations contained in the online shop do not constitute binding offers, but serve to submit a binding offer by the customer.
3.2 The customer can submit an offer using the order form integrated in the online shop. After entering their data and clicking the order button, the customer submits a legally binding contractual offer.
3.3 The Seller may accept the Customer’s offer within five days,
-by sending an order confirmation in text form (e.g. e-mail), or
-by delivering the goods, or
-by requesting payment from the customer after placing the order.
3.4 Input errors can be corrected before submitting the order using the usual correction functions of the browser.
3.5 Contract language is exclusively
German.
4. Prices and payment terms
4.1 All prices are final prices in euros and include VAT.
Additional shipping costs will be shown separately.
4.2 The following payment methods are available to the customer:
- Credit cards (Visa, Mastercard, American Express)
- Klarna
- PayPal
- Apple Pay
- Google Pay
- Girocard
4.3 Payments are processed via the payment service provider Shopify Payments (Stripe Payments Europe Ltd., Dublin) and, depending on your choice, via the respective providers (e.g., Klarna, PayPal). The terms and conditions of the respective providers apply.
5. Shipping and delivery
5.1 Delivery will be made to the delivery address provided by the customer within the delivery area specified by the seller. The delivery address provided during the ordering process is decisive.
5.2 If delivery fails for reasons for which the customer is responsible (e.g. incorrect address, non-collection), the customer shall bear the resulting additional costs.
5.3 If the customer acts as a business, the risk of accidental loss or accidental deterioration of the goods shall pass to the customer as soon as the seller has handed the goods over to the freight forwarder or carrier. If the customer acts as a consumer, the risk shall only pass upon delivery of the goods to the customer.
5.4 The Seller reserves the right to withdraw from the contract in the event of improper delivery. This only applies if the Seller has concluded a specific hedging transaction and the non-delivery is not the Seller's responsibility. In this case, the Customer will be informed immediately, and any payments already made will be refunded.
5.5 Self-collection is not possible for logistical reasons.
5.6 Delivery times: within Germany 3-5 working days from receipt of payment, within the EU approx. 5-7 working days.
6. Right of withdrawal & returns
The statutory right of withdrawal of 14 days applies (see cancellation policy below). The customer bears the return costs.
Goods that have been worn or soiled for hygiene reasons, as well as individually manufactured products, are excluded from the right of withdrawal.
7. Retention of title
The goods remain the property of the seller until full payment has been made.
8. Liability for defects (warranty)
8.1 The statutory warranty rights apply.
8.2 The following applies to entrepreneurs:
- For new goods, the limitation period for defects is one year from
Delivery of the goods. - For used goods, warranty claims are excluded.
- The limitation period does not begin again if a replacement delivery is made within the scope of liability for defects.
8.3 The above restrictions shall not apply if a defect was fraudulently concealed or a guarantee was given.
9. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this only applies to the extent that it does not deprive them of mandatory protective provisions of the country in which the consumer has his or her habitual residence.

Cancellation policy
You have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.
To exercise your right of withdrawal, you must inform us (Rüya Moda, owner: Vildan Özsayan, Landstraße 69, 45968 Gladbeck, email: info@rueyamoda.com, WhatsApp: +49 174 212 3575) of your decision to withdraw from this contract by means of a clear statement (e.g. by email or WhatsApp).
Consequences of revocation:
If you cancel this contract, we will reimburse you all payments that we have received from you (except for delivery costs) without undue delay and at the latest within 14 days from the day on which we received notification of your cancellation.
For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.
We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return the goods to us promptly and in any event no later than 14 days from the date on which you notify us of your cancellation. You will bear the cost of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
